In consideration of Coast Capital Savings agreeing to make Coast Online Banking available to the Customer, the Customer agrees as follows:
“Account” means any account of the Member with CCS.
“CCS” means Coast Capital Savings Credit Union.
“Coastonline Banking Services” means the online remote financial services offered from time to time by CCS which are presently accessed by Members through use of PAC, a personal computer, the Internet and the Software.
“ Member” means the person who executes the Application. If two or more persons execute the Application as joint tenants, the Member comprises each of those joint tenants.
“PAC” means the personal access code or word selected by the Member for the Member’s sole use which permits access to the Coastonline Banking Services and Contact Centre Services.
“Software” means any CCS computer software which permits access to Coastonline Banking Services or any other Services, and includes all upgrades, revisions, releases and new versions of such software which CCS makes available to the Member from time to time.
“Transaction” means any transaction performed utilizing any of the Services including, but not limited to, a point of sale purchase, a bill payment or the transfer of funds between Accounts.
The Member agrees to follow the instructions of CCS with respect to the use of Coastonline Banking Services. CCS may change permitted Transactions and instructions at any time.
The Member may use Coastonline Banking Services to conduct such Transactions as may be permitted by CCS. When the Member conducts a Transaction using Coastonline Banking Services, once the Transaction has been processed, the Member may not revoke or stop such Transaction.
The Member agrees that Coastonline Banking Services are available only on an “as is” and “as available” basis. The availability of Coastonline Banking Services is dependent upon telecommunication lines, computer hardware and software and other equipment belonging to CCS and to third parties.
The Member irrevocably authorizes and directs CCS to debit or credit, as the case may be, the amount of any transaction to an Account in accordance with the normal practices of CCS. CCS’ procedures respecting the debiting and crediting of any Transaction may be revised from time to time with or without notice to the Member.
CCS may modify the format of or restrict the use of Coastonline Banking Services, or terminate the Member’s right to use Coastonline Banking Services at any time without notice. The insolvency, bankruptcy or death of the Member will constitute an automatic termination of the rights associated with Coastonline Banking Services and the PAC.
When Coastonline Banking Services are used for transfers of funds from an Account (whether to another Account of the Member or to another Member’s account), funds are irrevocably transferred from such Account. The Member is responsible for ensuring the accuracy of the recipient account numbers to which the Member intends to transfer funds. CCS is not liable for any loss or damage as a result of funds being transferred to the wrong recipient if the Member used the wrong account number. CCS is not responsible or obligated to retrieve or return such funds to the Member.
When Coastonline Banking Services are used for bill payments, funds are irrevocably transferred from an Account. The Member is responsible for ensuring the accuracy of the billing account number to which the Member intends to transfer funds. CCS is not liable for any loss or damage as a result of funds being transferred to the wrong recipient if the Member used the wrong account number. CCS is not responsible or obligated to retrieve or return such funds to the Member.
The Member may use Coastonline Banking Services to access any permitted Account and to conduct such Transactions as may be permitted by CCS.
If the Member wishes to use Coastonline Banking Services, the Member must obtain a copy of the Software from CCS. CCS grants the Member a licence to use one copy of the Software in compiled form only.
The Member has no rights in or to the Software other than the limited licence to use the Software as set out in this Agreement.
The Member will use the Software only for the purposes of using Coastonline Banking Services to access any permissible Account and to perform authorized Transactions.
The Member agrees not to copy, modify, reverse engineer, decompile, disassemble the Software, or attempt any of the foregoing.
The Member will not assign, transfer, rent, loan or sell the Software to any other party.
If CCS makes available a new version of the Software, then the Member acknowledges that CCS may not continue to support the prior version of the Software.
CCS makes no representations or warranties with respect to the Software, which is provided “as is”. The Member waives and CCS disclaims all warranties and conditions, express or implied, with respect to the Software and its use by the Member, including, without limitation, any warranty or condition of merchantable quality, durability, performance, title or fitness for a particular purpose.
The Member agrees that any electronic display pages accessed by way of Coastonline Banking Services constitute written agreements and that by clicking or otherwise activating “OK”, “Proceed”, “I Agree” or similar areas on the screen in accordance with on-screen instructions will have the same effects as if the Member had signed and delivered hard copy versions of such agreements to CCS and the Member will be legally bound by the terms of such agreements.
